Welcoming address by Herdís Thorgeirsdóttir, President of the European Women Lawyers’ Association at EWLA’s 10th Anniversary Congress in Brussels on 3 June 2010 – Law as Politics in societies at crossroads –

Today we celebrate the 10th anniversary of the European Women Lawyers Association. EWLA was founded in Brussels at the turn of the millennium having in particular the aim of promoting women’s equality and fundamental rights.
From its inception EWLA has called on EU Institutions to ensure through legislative action that sex discrimination does not lag behind protection against other types of discrimination; it has called for the balanced participation of women and men on the boards of listed companies. EWLA has in short emphasized the positive obligation imposed on the EC/EU institutions and organs as well as Member States to “actively promote gender equality.

”Women are more than 50% of the population and should be equally visible, influential and responsible as men in political and public life. Much progress has been accomplished in the area of European co-operation and legislation as regards de jure gender equality but reality lags behind. The objectives are clear but we lack results.
EWLA has emphasized that in order to ensure its future and cope with the challenges of globalization, that the social and economic goals on the EU agenda cannot be achieved unless effective measures are taken to improve women’s situation in society at large. With the current economic crisis, the feminization of poverty has increased – two out of every three adults that are poor are women.

Economic considerations and limited resources determine the extent of social measures . . . but there are further shortcomings in the quest for a just society. We are not only faced with economic crises but also crises of confidence; an erosion of trust in financial, social and political institutions is spreading throughout societies like eczema.
The Times They Are a Changin[g ] to quote the Bob Dylan’s lyric from the sixties – “the order is rapidly fadin[g]”.
This is no understatement when coming from Iceland. After the whole banking system collapsed in October 2008, a volcanic eruption has in recent weeks threatened the existence of air travel all over Europe – and just three days ago a political earthquake shock Iceland with a comedy political party winning local elections in Reykjavík. The so-called Best Party took the political establishment by surprise in the Icelandic capital of Reykjavík, securing 6 out of 15 seats in the new city council. One of the issues this party emphasized was a drug-free parliament in 2020 – I have not heard of one MP who is really addicted to drugs – but having this slogan and winning the elections shows that people are ready for change – any kind of change.
The prime minister acknowledged that this could spell the end of the traditional four-party-system in Iceland. Recent opinion polls show that political leaders are looked upon with distrust and contempt.
The situation in Iceland may be quite extreme but we know that unrest is lurking underneath widely in Europe. The Euro has hit a four year low against the dollar; unemployment in the Eurozone has hit a fresh height and across the 27 EU countries there are now 23 million people unemployed. Some say that the key test for market economies, perhaps even for democracies, is how they master growing inequalities triggered by ungoverned globalization and aggravated by the crisis. Womens’ rights around the world are an important indicator to understand global well-being.
Law as politics – in societies at crossroads was the theme chosen for this congress many months ago. We intended to pose a question and designate the need for greater attention to the interplay between these forces – in particular fundamental rights and the market economies and the political atmosphere surrounding these.
How secure are the foundations of modern Europe? Where exactly does our strength to confront the present situation lie.

The sad thing is that the institutions that are supposed to inspire the most trust; the pillars of most societies – the press, political leadership, the corporations are subject to mistrust by the public in many if not most states. We need a dialogue on restoring trust – everywhere – without trust decline is inevitable.
I hereby open EWLAs 10th anniversary congress with the sincere hope that we, European Women Lawyers’ can help contribute to this dialogue of restoring trust; so that right will make might (to quote Abraham Lincoln) – that is exactly what lies at the core of focusing on law as politics.

Ráðstefnan Tengslanet V – völd til kvenna haldin á Bifröst. Hef skipulagt þessar ráðstefnur frá 2004 og fengið marga þekkta, erlenda fyrirlesara ásamt stórum hópi íslenskra kvenna – úr öllum áttum. Í þetta sinn bauð ég bandaríska metsöluhöfundinum Barbara Ehrenreich að  koma til Íslands og vara aðalfyrirlesari á tengslanets-ráðstefnunni. Sjá frétt hér og hér.

Prófessor: Fyrirtæki, stofnanir og stjórnvöld taka lögin ekki alvarlega og þverbrjóta reglur

Dr. Herdís Þorgeirsdóttir, prófessor og forseti Evrópusamtaka kvenlögfræðinga, segir að fyrirtæki, stofnanir og stjórnvöld taka lög almennt ekki nógu alvarlega, sniðgangi þau meðvitað eða ómeðvitað enda eru grundvallarreglurnar þverbrotnar eins og best sést á viðvarandi launamun kynjanna.

Herdís segir í samtali við Pressuna að það sé illt í efni ef konur sem heild eru nánast útilokaðar frá stjórn samfélagsins, opinberum stofnunum, fjölmiðlum og fjármálafyrirtækjum. Samkvæmt rannsókn Creditinfo fer konum í stjórnum íslenskra fyrirtækja fækkandi og eru nú 14% stjórnarmanna. Hún segir karla ráðandi í efstu lögum samfélagsins og að jafnréttislögin eigi að jafna stöðu kynjanna á öllum sviðum. Herdís stendur fyrir kvennaráðstefnunni Tengslaneti í vikunni.

Ég hef sagt það áður að það er álit mitt að fyrirtæki, stofnanir og stjórnvöld taka lögin almennt ekki nógu alvarlega, sniðgangi þau meðvitað eða ómeðvitað enda eru grundvallarreglurnar þverbrotnar eins og best sést á viðvarandi launamun kynjanna.

Herdís segir að margar konur segi samfélagið andlega samkynhneigt þar sem karlar eru annars vegar, þeir sjái ekki konur sem stjórnendur eða raunverulega ákvarðanatökuaðila í mikilvægum málum.

Þetta er afleitt vegna þess að konur eiga að koma slíkri ákvarðanatöku ekki eingöngu á grundvelli eigin réttinda heldur vegna hagsmuna heildarinnar. Þegar harðnar á dalnum þjappa karlarnir sem fyrir eru í valdastöðum sér saman og hleypa kannski einni konu upp til málamynda. Til að vinda ofan af þessari þróun verða konur að snúa bökum saman – ekki gegn körlunum heldur vegna þeirra hagsmuna sem í húfi eru.

Herdís segir að markmið jafnréttislaganna þar sem segir að konur og karlar skuli njóta jafns réttar í hvívetna sé að útfæra jafnræðisregluna með ítarlegum hætti og þá ekki síst í tengslum við konur sem sérstök hætta þykir á að geti sætt mismunun. Hún telur ákvæði um kynjakvóta í stjórnum íslenskra fyrirtækja ekki afgerandi, ekki frekar en ályktun sem Evrópusamtök kvenlögfræðinga (EWLA) sendu frá sér þar sem þing ESB og framkvæmdastjórn eru hvött til að leggja að stjórnvöldum að ýta undir gagnsæi um upplýsingar um samsetningu stjórna í skráðum hlutafélögum.

Herdís er jafnframt forsprakki kvennaráðstefnunnar Tengslanets sem haldin verður á Bifröst síðar í vikunni. Þar verða m.a. umræður um mikilvægi þess að jafna hlut kynja í stjórnum fyrirtækjanna. Ein framsögukvennanna, Brynja Guðmundsdóttir, heldur því fram að nú sé lag fyrir konur að kaupa fyrirtækin.

Ég held að konur geti ekkert beðið eftir því að misáhugasamir karlstjórnendur leiðrétti kjör þeirra eða ýti undir áhrif þeirra innan fyrirtækja, stofnana eða í samfélaginu. Konur verða sjálfar að stíga fram; eiga frumkvæði og taka til sinna ráða. Lögin eru ekki nógu afgerandi og eftirfylgni með framkvæmd jafnréttislaga þaðan af síður.

Herdís segir að þegar hafi á þriðjað hundrað kvenna skráð sig á ráðstefnuna en skráning stendur enn yfir.

Það merkilega við tengslanetið er að það er enginn einn hópur meira áberandi en annar. Þátttakendur koma víða að úr samfélaginu. Margbreytileikinn einkennir einnig framsögukonur. Aðalfyrirlesarinn er bandarískur metsöluhöfundur sem þekkir kjör kvenna vel og ekki síst þeirra lakar settu. Þetta verður rætt enda er ein framsögukvenna formaður Mæðrastyrksnefndar í Reykjavíkur og aðrar framsögukonur þekkja innviði kerfisins og samfélagsins frá mörgum sjónarhornum. Flestar eiga þó það sameiginlegt að vita af eigin raun að samstaða kvenna er ekki bara gildi í sjálfu sér heldur eina leiðin til að ná árangri í þeirri mannréttindabaráttu sem jafnrétti kynjanna er.

Umfjöllun Jafnréttisstofu um Tengslanet V

Bandaríski metsölurithöfundurinn Barbara Ehrenreich verður aðalfyrirlesari á Tengslaneti V-Völd til kvenna ráðstefnunni sem haldin er 27 – 28 maí næstkomandi. Ehrenreich þykir einn róttækasti samfélagsgagnrýnandi sem nú er á ritvellinum. Bók hennar Nickel and Dimed var í ár valin ein af tíu bestu bókum síðasta áratugar á sviði rannsóknarblaðamennsku af blaðamannstofnun New York háskóla. Annar aðalfyrirlesara nú er Dr. Sigríður Benediktsdóttir, einn höfunda rannsóknarskýrslunnar, en hún mun leggja út af þema ráðstefnunnar um hugrekki í erindi sínu um aðdraganda og eftirmála hrunsins. Um 30 aðrar konur eru með framsögur á ýmsum sviðum.
Barbara Ehrenreich er þekkt fyrir baráttu sína fyrir réttindum kvenna. Hún skrifaði um árabil í  MS tímarit Gloriu Steinem; er doktor í líffræði en hefur helgað líf sitt ritstörfum. Hún er höfundur margra bóka og greina; er dálkahöfundur í stórblaðinu New York Times, vinsæll gestur í sjónvarpsþáttum; þykir eitursnjall penni, frábær fyrirlesari og Lundúnablaðið Times hefur kalla hana Jonathan Swift samtímans vegna skarprar sýnar hennar á öfgar og óréttlæti. Þegar hún skrifaði Nickel and Dimed gerðist hún sjálf gengilbeina til að kynnast af eigin raun kjörum þeirra sem komast ekki af í Bandaríkjunum. Hún er sjálf hámenntuð en sagði að láglaunastörf ætluð þeim sem enga færni hafa væru í raun störf sem krefðust oft mikillar einbeitingar, úthalds og þess að fólk sé fljótt að hugsa. Hún segir að þessi láglaunastörf séu ekki eingöngu vanmetin heldur einnig miklu erfiðari um margt auk þess sem þeir sem þeim gegni séu oft að fórna miklu. Þá bendir hún á hvernig atvinnurekendur notfæri sér iðulega eymd þessa fólks. Í nýjustu bók sinni Brightsided sem vakið hefur mikla athygli gagnrýnir hún „jákvæðni-iðnaðinn“ sem gengur út á að láta fólk meðtaka hlutskipti sitt eins og brosandi vélmenni í stað þess að vera raunsæir, gagnrýnir borgarar.

Tengslanetsráðstefnan er fjölsóttasta og vinsælasta ráðstefna sem haldin er í íslensku athafnalífi. Dr. Herdís Þorgeirsdóttir prófessor er stofnandi og skipuleggjandi ráðstefnunnar sem var fyrst haldin 2004. Árið 2008 sló ráðstefnan aðsóknarmet en þá sóttu hana 500 konur. Dagskrá ráðstefnunnar er á heimasíðu Bifrastar www.bifrost.is Þar er einnig hægt að skrá sig og fá upplýsingar um gistingu.

Ráðstefnan hefst með göngu á Grábrók á fimmtudagskvöldinu með þátttöku frambjóðenda allra flokka í sveitarstjórnarkosningunum.
